You are right to be concerned. A public forum such as this is not the place to discuss these matters. You need to speak to a lawyer at his/her office about these issues of drug possession and domestic abuse at once. These are very serious questions that need to be discussed and answered in a private attorney-client setting.

  • Juvenile sex offender. Age 12-13 at the time of adjudication. Is it possible to expunge, seal, or overturn ruling?

I have several complex questions for attorneys in Maine. 1) Can a child adjudicated of a sexual offense at the age of 12-13 expunge, seal, or otherwise overturn the ruling? Please, bare in mind that the child has had no priors and has not comm...

    Donna’s Answer

Any complex question requires legal research by an experienced attorney in your home state of Maine. Since the case is apparently 14 years old, any appeal period has likely expired. Generally speaking, a child's records are not public but are often available to law enforcement/prosecutors. You should call an attorney in Maine and consult with him/her on these issues. It is definitely too complicated and personal to answer in an open forum such as this.

  • I had an under Wisconsin law, If an minor attacks an adult, what are the adults rights concerning self defense?

My 13 year old brother who weighs 130 lb deliberately attacked me with no provocation, and I was unable to leave the area due to his attacking. I am a 22 year old female weighing 120 lb. He attacked me with closed fists, yet the only defense I had...

    Donna’s Answer

You have a right to use self defense when you are being attacked, whether by a minor or another adult. You can only use necessary force to stop the attack. It sounds like that's just what you did. If you get charged with a crime, then you will need to speak to a lawyer.

  • If a person moves to another state, do SO Registration requirements from original state carry over to new state?

Living in WV for now. I am currently trying like hell to get off of probation early for a misdemeanor sex offense. It was my first offense, no prior criminal record, clean polygraphs and drug screenings, and so on. I want to leave my current state...

    Donna’s Answer

This is an important issue and varies by state. Some states permit expungement and others do not. Every state has their own rules for sex offender registration but generally speaking, if you are required to register in your state of conviction, then you will also need to register in any state that you move to. It sounds like you were convicted in WV so, therefore, you should contact an experienced criminal defense attorney in WV to get your questions answered. He or she can also talk to you about what options might be available to you.

  • Is it a good idea to not go to a revocation hearing and go straight to the law judge?

My bf has a revocation hearing for the 19th of this month and is considering skipping that so he can go infront of a law judge. He does not want to go back to prison is it possible that a public defender can talk to his probation officer and ask t...

    Donna’s Answer

An attorney is always able to talk to a probation agent and request an ATR (alternative to revocation). But that requires an analysis of your boyfriend's alleged violations and any treatment needs that he needs. It is not a simple answer. You need to get legal advice.

    Donna’s Answer

You should contact a lawyer in Missouri. Here in Wisconsin, the likelihood is good that it would be converted to a civil judgment. Also, unpaid restitution would not be a basis to extend your supervision.

    Donna’s Answer

My advice is to just pay it now. All should then be okay with your agent. Since it is now in collections, you need to contact the collection company to make monthly payment arrangements.

  • How do I take care of a past shoplifting charge?

I currently have a shoplifting charge from Maricopa County that I got in December of 2010. My situation was this. I believe I was told to either pay a fine, or do time served. I went with time served. Then I believe I was told I could sign up for ...

    Donna’s Answer

You need to speak to an AZ lawyer for specifics. But here in Wisconsin, that would still be possible under your circumstances. The sooner you contact the state to make those arrangements, the better.

  • Is there such a thing as a Non-extraditional warrant?

I got a call from the CT State Troopers, stating there is an arrest warrant for me, and i was not told the charges, or got any paperwork in the mail before this call. After talking to a MA state trooper, and another CT state trooper office, both d...

    Donna’s Answer

You really need to call a CT or MA lawyer for help on this one. However, generally speaking, states will not extradite if the underlying crime is a misdemeanor. If it's a felony, then yes they will.

I would suggest getting in touch with a different attorney in Texas to look more closely into the matter. It sounds like the matter is not being pursued but you should have someone check again.
