Description: Client was slain in the spirit and fell to the floor without an usher present to catch her, causing a head injury. After failed attempts to amicably work through the Church for payment of medical expenses, client filed suit against the Church and the Pastor. After being informed of the lawsuit, the Pastor made statements against the Client, both orally and in writing, which resulted in our filing an amended complaint to add counts of slander and libel. Following a jury trial, the Client was awarded damages on the injury, slander, libel and false light. The Church appealed the verdict to the Michigan Court of Appeals, which upheld our injury verdict but remanded for a new trial on the defamation counts. We filed a Motion for Reconsideration in the Court of Appeals, which produced one modification in the vote. We then filed Application for Leave to Appeal to the Supreme Court, were granted mini-arguments and subsequently obtained and Order reversing the judgment of the Michigan Court of Appeals and reinstating the jury verdict.
