You don't say what state your divorce took place in. I can only tell you what applies in Michigan. In order for you to receive a portion of your husband's pension, there would have had to have been a provision in your divorce judgment identifying the pension and what portion you are entitled to. I recommend that you consult an attorney in the state in which you obtained your divorce to find out whether you can now get a portion of your ex-husband's pension.

I would suggest you let the children leave from LAX. The important issue is that your husband have his time with his children. If she is choosing a flight at 7 p.m., from LAX, they will be on the "red eye" How old are the children? Will it be too difficult for them to take a "red eye" If she is planning on the children leaving Michigan at 7p.m. then it should not be an issue. Keep in mind that the airport they leave from is not as important as just getting them to Michigan.
You should file a new motion. If that one was never acted on it may not have ever been properly filed or scheduled. File the motion according to the procedure in the county in which the case took place. If you are not sure how to go about filing the motion you should consult an attorney.

Assuming the divorce was filed in Missouri, you should contact an attorney in Missouri so you can find out what the process and procedure is in a divorce in that state. You should also ask the attorney to review the paperwork you were served with and give you advice as to how you should proceed. If you do nothing you are taking a risk that you will not receive your fair share of your marital property. You definitly need to contact an attorney in the state in which the divorce was filed.

If you wife contacted a number of attorneys and asked questions or for advice, or asked what their fees were, that attorney cannot represent you precsely because he/she has given your wife advce and/or information. I would believe that there are more than 20 family law attorneys in your community or at least in your county. You also may want to contact attorneys out of your county who may practice in your county.
