    The expungement law specifically excludes traffic related offenses including drinking and driving. Sorry to break the bad news.

    Something like this is usually discretionary with the judge. I would absolutely hire an attorney to keep as much of the criminal record off of your record as possible.

    I'm sure a lot of people could respond to this post and go on about the politics of drinking and driving, MADD, and other interest groups. DUI is a major money maker for the courts, police, state, testing groups, etc. They relate the testing to the offense under the bond conditions.

    Get on a payment plan with the Michigan Secretary of State Treasury. They are very liberal and as long as you are paying you will be able to get a license. You will need to attend a driver assessment and appeal division hearing. You will have the burden to show by clear and convincing evidence that you have not drank alcohol for at least a year and will not drink alcohol in the future. I have handled countless hearings.     He should not be talking to anyone but his lawyer. He should be arraigned and a bond applied. Having a lawyer at that hearing could help a lot.

    My guess is that you would have to search in New York. Here in Michigan we have iCHAT that allows you to look up someone record for $10. Juvenile stuff often will not show. NY may have a different system. You could always ask him what court it happened at and call that court or request the info under FOIA. If nothing comes up then it either wasn't at that court or it was sealed.
