    A personal representative will be appointed to represent the Estate. In Michigan the highest in priority would be the children, so generally their guardian would be the personal representative. After the case is settled the funds will be distributed to the interested parties by consent or order of the probate court. It can be set up as a trust at the time of distribution or settlement.     You would most likely have to bring the action in Tennessee. If you hired an attorney in Mississippi, they can represent you in Tennessee if 1) The lawyer is also licensed in Tennessee or 2) The lawyer can file a motion with the Court to be admitted for the purpose of handling the case. This is sometimes done with the firm hiring local counsel to admit them in the State with a motion. Good luck

    You can hire an attorney and have them send the insurance company a bad faith letter. The letter should indicate that they have advised you that you could have to pay 2 million and that you want them to offer the policy limits to settle the case in full. This is called a bad faith letter and an experienced personal injury will understand what to do. Good luck.

    One of your employees was driving and caused an accident. Was the other individual also an employee of the same company? Why did the company have such a small insurance policy? Is this the auto policy or the workman compensation policy. Can you clarify the facts a bit more. Thank you.

    In MIchigan it is typical to find an attorney to do a free consultation. Call around in TX and find an attorney that does injury cases and does free consultations and works on a percentage basis. I do not know enough about the facts of your case, but if it is viable you should be able to find an attorney. Try AVVO and look for a texas lawyer to start. Good luck.

    You can settle it yourself if you are sure that you will not have any more problems in the future. What are they offering? Does it cover your medical bills?
