At a minimum she could get checked out by a doctor. Some commercial policies have a "medpay" provision that pays the medical bills regardless of fault up to a limit. Usually $1,000.00 to $5,000.00

Progressive refused to pay my client any of her benefits and offered me zero to settle. After a two week trial the jury awarded my client $250,000.00 and we obtained another $100,000 in costs, interest and attorney fees. The verdict came in June 2012. The jury was so disgusted with them they gave me everything I asked for. They can be very difficult and unreasonable. Get an attorney fast.

A personal representative will be appointed to represent the Estate. In Michigan the highest in priority would be the children, so generally their guardian would be the personal representative. After the case is settled the funds will be distributed to the interested parties by consent or order of the probate court. It can be set up as a trust at the time of distribution or settlement. You would most likely have to bring the action in Tennessee. If you hired an attorney in Mississippi, they can represent you in Tennessee if 1) The lawyer is also licensed in Tennessee or 2) The lawyer can file a motion with the Court to be admitted for the purpose of handling the case. This is sometimes done with the firm hiring local counsel to admit them in the State with a motion. Good luck

You have a workman compensation case if you were injured. You do not indicate what injury, if any, you sustained. There could be a third party case, but there are not enough facts here to know whether that is a claim worth investigating. Good luck.

You can hire an attorney and have them send the insurance company a bad faith letter. The letter should indicate that they have advised you that you could have to pay 2 million and that you want them to offer the policy limits to settle the case in full. This is called a bad faith letter and an experienced personal injury will understand what to do. Good luck.

One of your employees was driving and caused an accident. Was the other individual also an employee of the same company? Why did the company have such a small insurance policy? Is this the auto policy or the workman compensation policy. Can you clarify the facts a bit more. Thank you.
