  • Incorrect marriage date listed on divorce papers

my sister is divorced but her divorce papers list the wrong date of marriage. she was married to the same man twice but the date on the most recent divorce papers is from the first marriage to him, not the second. are these actually legal?

    Perry’s Answer

No problem. She can amend the pleading if the divorce is still pending or have the court do it in its decree. If case is over and decree issued, then it's really harmless error and doesn't compromise relief granted, that being the dissolution of marriage

  • Me and my husband was married 24 years he filed for divorce after cashing his 401 k plan was i entiled to part of that

we have been seperated for 4 years we no children is there anything i can do with out getting a lawyer

    Perry’s Answer

If it had existed on date of filing yes but if not , then your ownership would transfer to the cash he received from the 401k...a new debt may been created due to taxes owing on the 401k withdrawl.......this assumes he hasn't, spent the money or bought something
