    no/ you may void your underinsured motorist coverage if you do--the proper way is to make an underinsured motorist claim-you will need your insurance companies permission to even accept the other drivers underlying limits-its complicated so see a lawyer.

    Indiana unfortunately has tort reform for malpractice claims making it very difficult, expensive to pursue and usually taking years to litigate ! as a result unless the injury is severe it is not economical to pursue.

    if the insurance company is even close to fair a lawyer really cant help as you'll incur fees which will reduce your recovery. In any event you cannot recover more than the fair market value of the vehicle.......

    Yes, most likely you can sue. However, you must first file the proper Notice to the city as required by laws there in Indiana. Unfortunetly there must be notice to the City of the pothole--this is difficult to prove and as a result these claims often fail !
