    Client and wife were on their way home from an anniversary celebration when he was stopped for multiple marked lane violations. After performing the HGN (eye test) he was told he was being placed under arrest. At this point he began repeatedly calling the officer an ass hole. The beligerant behavior continued throughout the rest of the arrest and processing. The client refused to submit to a breathylizer. The jury deliberated for 15 minutes before returning a NOT GUILTY verdict.

    Due to persistance and unique facts, prosecutor agreed to amend the OVI to a reckless operation. It took months to get the case resolved and presentation of evidence/justification to get the State to agree to amend the charge. This result may not be representative of every high tier breath test case, but persistance paid off in this specific set of facts.
