To answer this question, it may be important to know when the officer was on administrative leave and why. Just because the officer was placed on administrative leave does not necessarily make it relevant to your case or make the officer's credibility questionable. You need a lot more information before you can say you were misled and/or duped in entering a plea. You may want to get a new lawyer to review this matter for you if you are concerned. Use the kacdl.net website to find a new attorney.

You need to contact the Kentucky Bar Association. They may be able to help you with recovery of your money through the Client Security Fund which was established to help indemnify people who are the victims of dishonest lawyers. There is no guarantee that the fund will be able to pay you back but it is worth it to ask. Good luck.

Generally, any assets received through inheritance are considered separate property (non-marital). In addition, martial assets are to be divided equitably without consideration of wrong doing in the marriage. However, when non-marital assets are commingled they can sometimes lose their non-marital characterization. You need to consult an attorney in your area about your specific facts and circumstances. Good luck.

  6. What happens if no evidence is submitted at the pre trial?

The Pretrial Conference is not when evidence is submitted. There may be discussion of the evidence in the case, but the Court does not generally take evidence during a pretrial conference. The pretrial is typically a chance to lay out the contested issues and discuss how the trial should proceed. The submission of evidence will take place at the trial. Your brother's attorney should already have a good idea of the evidence which will be used at trial by reviewing the discovery. Good luck.

It is likely that a bench warrant has been issued for failing to appear for trial. Judges do not take kindly to those who fail to appear when required to do so. She needs to contact her attorney as soon as possible and discuss her situation to try to minimize the punishment which may be coming. If she does not have an attorney, she needs to retain one as soon as possible.

Just because you may leave Washington does not mean the warrants will not be executed on you. If you are caught in another state, you could be subject to extradition. This is not likely for misdemeanor charges. It seems a better idea to address the charges and put them behind you. In addition, due to the lengeth of time since you were charges, it may be difficult for the state to find the necessary witnesses to prove their case. You should hire a criminal defense attorney to look at these...
