Mr. Gray was charged with capital murder when he was just 14 years of age. He was tried and acquitted three years later, despite a confession and the testimony of two supposed eyewitnesses.

Appeal of murder conviction after denial of defense's requested manslaughter instructions. Conviction reversed and remanded 7-3 by Mississippi Court of Appeals. Ultimately Mr. Cole pled guilty to the manslaughter charge Mr. Eichelberger fought for at trial and on appeal.
