I believe you are asking about how the government will show that the blood is yours, and not someone else's. The government must establish a chain of custody for the blood, which is evidence. A criminal defense attorney should be able to establish whether or not there is a chain of custody problem with the blood and raise any objections accordingly.

Although I have never been in jail myself, I have visited my clients there many times. I know jail is a tough place to be. I would advise you against contacting the jail or any member of law enforcement about this without first talking to your loved one's attorney. It could be that the attorney is very concerned about attorney-client confidentiality issues. Jails can be full of snitches. It could be that the attorney is concerned about your friend's brother repeating what the attorney tells him to other inmates- again, because jails are full of "false friends" who trade information with the government for favorable treatment in their own cases.

Theft is graded in Tennessee based on the value of the property. Theft under 500 is aggressively prosecuted in some places and not in others. My experience is that rural and less populous areas are more strict. As a first offender you are diversion eligible. Upon completing diversion you can have it expunged and your record will then be "clean" .
