    John’s Answer

You should absolutely consult with a lawyer. Whether you have a viable sexual harassment or retaliation claim I cannot say based upon the information provided, but you should call a lawyer who handles employment issues regarding the wording of any and all exit documents you sign.

  • Do I need a special Lawyer?

Yes me and a co worker were hit by a semi. We were stopped to let oncoming traffic pass and were turning left. When we were turning a tractor trailer went to pass on the left resulting in a t bone accident on my side the driver (the semi passed ...

    John’s Answer

You need a lawyer experienced in dealing with semi truck cases. Tractor trailers and other large commercial vehicles have specialized safety and driving regulations that a trained trucking crash lawyer can identify and use to maximize your award. You also need a lawyer who is experienced in the courtroom. Many lawyers claim to be tough advocates but have a reputation within the industry for settling cases, which means the trucking company's lawyers will give low offers knowing the attorney will cave. Seek out a lawyer who is a certified civil trial specialist because they are screened for courtroom experience. If possible, get a lawyer experienced with the judges and juries where the case would have to be brought, which is typically the county where the crash happened. You should also get a lawyer with experience dealing with both spinal injuries and traumatic brain injuries, since you have suffered both and knowing your injury will allow the lawyer to properly question your doctors and prove the full extent of your damages. Good luck.

    John’s Answer

You need to consult and hire a new attorney as soon as possible. There are undoubtedly deadlines which must be met and other matters to attend to if your case is to be saved. If you were injured and the facts are as you've stated, you have a viable case even though your former attorney may have dropped the ball. I strongly recommend you hire an attorney experienced in litigation against the State of Tennessee through the Claims Commission and who has particular experience in auto collisions. Do not be misled: almost every lawyer will take a collision case because they "seem" easy to handle, but as you've already learned, things are not always what they seem and all lawyers are not created equal. You need someone with a track record of success to maximize your result. Good luck.

  • I didn't go to the ER at the scene of a wreck but now it hurts. How long do I have for their insurance to still cover it.

The accident was her fault she pulled out in front of me and I T-bone'd her vehicle. It totaled my vehicle and it had to be towed. I told them at the scene that I was alright but now my neck, back, and shoulders are getting pretty sore and it has ...

    John’s Answer

It is a common myth that an injured person must go immediately to the emergency room in order to recover in an injury claim arising out of an auto collision. In fact, most soft tissue injuries are not immediately obvious at the time of the incident. A knowledgeable attorney can assist you in navigating the various issues involved, including accessing medical care via med-pay insurance provisions or other means. I strongly recommend you consult with a Middle Tennessee injury lawyer to evaluate your claim and help you take advantage of every possible avenue for accessing the medical care you need.

  • Car Wreck, No Insurance, Police Report was inconclusive on who was at fault.

I was in a car wreck on Friday. I had the green arrow signal to turn left at the inter section and proceeded to turn. A car full of teenagers jumped the gun and hit me on the front right corner. I have no Insurance, but I called the police first....

    John’s Answer

Insurance companies love to deny these type claims, but you should definitely proceed with making a claim. If your car is of significant value, you may be able to find an attorney to represent you on a contingency fee contract or you could simply present the case yourself in general sessions court. If you are injured, you should seek appropriate medical treatment and consult with an attorney in your city as soon as possible.

  • Is it possible for a car turning left and the other car going straight to have a head on collision?

Daughter was making a left turn and had plenty of time to turn. The other car was going straight but then started speeding up and swerved and hit her head on. He didn't yield as he had a yield light. Her insurance company said if he was going stra...

    John’s Answer

Tennessee law holds as a general rule that a vehicle traveling straight has the right of way over one making a left turn, unless there is a traffic signal indicating otherwise. For this reason, your daughter would have an uphill and possibly expensive battle on her hands in trying to prove the other driver responsible. Eyewitness testimony corroborating her version would surely help, but even then it is a risky proposition.

  • Walmart will not help me!

I slipped at walmart last month on an unknown substance. I sprained my ankle and ended up with a herniated disc and numbness in my right leg. Walmart insurance companies will not gelp me. Will a lawyer take my case?

    John’s Answer

In order to win a premises liability case, the injured party must prove, during the liability portion of their case each of the following: (1) the party responsible for the party (in this instance, Wal-Mart) either knew, or should have known that a danger existed; (2) the party responsible for the property failed to adequately warn about or remedy the dangerous condition; and (3) the dangerous condition caused the injury. Along the way to proving these things, the injured party must avoid a number of potential pitfalls that could prove fatal to a claim. Wal-Mart has a reputation for playing hardball in these type claims and it is unlikely that you will reach a proper settlement without an attorney. I strongly recommend contacting a reputable lawyer in your community with experience in, not just settling, but litigating premises liability claims for a thorough examination and vetting of your claim. If the facts are such that liability can be proven, you will have no problem getting a lawyer, but you must do some homework to find the right representation.

    John’s Answer

If the facts are as you state, the woman who hit you would be held responsible. It is not uncommon for insurance companies to adopt the sometimes ridiculous stories of their insured drivers to avoid responsibility. In this situation I strongly suggest you contact an experienced lawyer in your town to discuss your options.

  • I left the scene of an accident but I came back, how long will my licenses be suspended for?

I came back in less than an hour and I have them my insurance information, there was no one hurt but there was property damage. Both cars are drive able.

    John’s Answer

Leaving the scene is a crime and you face consequences for committing it, but if you hire a qualified criminal defense attorney who regularly practices in the Memphis criminal court system, you may not face the harshest consequences. I strongly recommend speaking with a Memphis lawyer immediately.

  • How long do you have to file a law suit on injury from auto accident in state of tenn

Driving company car was hit by another person which was driving without insurance. uninsured motorist part of company policy is taking care of claim.

    John’s Answer

In this scenario you have two different claims that need attention. Since you were driving a company vehicle, you likely have a claim for workers' compensation benefits as well as an auto negligence claim. Be very careful in choosing your medical care. On one hand, the workers' compensation carrier will pay for your medical treatment related to the injury; on the other, doctors chosen by workers' compensation carriers are often notorious "company doctors" who tend to conservatively evaluate injuries and problems caused by them. Also, workers compensation has an absolute right to recover from the auto insurance claim all monies advanced by them on your behalf. This is not a simple fender bender which can easily be handled without a lawyer. I suggest you contact someone knowledgeable in workers' compensation and uninsured motorists claims to help navigate this process.
