If after year going by and you didn't know you had a child you didn't know if I sign away my rights do I have to pay child suppo

Asked by a user in Memphis, TN - 5 months ago.

If you are the biological parent of a child and you are not the primary custodial parent, yes you have to pay child support. You can sign your rights away if there is another person willing to adopt the child and take your rights as the non-custodial parent. Understand, the child can not go from having two parents to having one. The child has a right to have two parents. It takes the agreement of three capable adults to allow one of them to sign rights away and another to take their place. An...

Anyone deals with expungement in memphis tn.

Asked by a user in Memphis, TN - 5 months ago.

To better guide you, there is alot of information needed. Did you have an attorney handling your felony plea or conviction? Was there an expungement or diversion agreement? Generally, A person can only get a felony expunged upon the completion of a qualifying diversion program. Felony convictions stay on a record forever. One may petition for a restoration of rights.

I'm disabled with no income. My husband left me 3/24/11,saying he was filing for divorce.

Asked by a user in Erin, TN - about 1 year ago.

You need to hire an attorney to contact his attorney to find out if he is filing or not, file for divorce if he isn't soon, get a restraining order as a part of the divorce filing to prevent the disposal or change of any property & file a motion to set temporary support. Once you are granted temporary support, have your doctors document that you are unable to proceed with the divorce and sit back and collect his money for a few years until he can get you back in Court. Then just before trial...

Can my insurance refuse to pay a personal injury claim of a person who rode in the other car during an accident I was at fault ?

Asked by a user in Pittsburgh, PA - about 3 years ago.

First the disclaimer: I am licensed in TN, therefore I cannot give you specific advice as to Pennsylvania law. However, as a general rule, your insurance company can deny any claim. It is then up to the adverse party to bring suit within the statute of limitations for that state. If you are sued, your insurance company has a contractual obligation to defend the claim under the terms of the insurance coverage you purchased. Your insurance company is obligated to pay an attorney to defend...

Is this a case i can win?

Asked by a user in Chula Vista, CA - about 3 years ago.

Hi. First , I must tell you that I am a TN attorney and I am not licensed to practice in CA. I can answer your question based on my TN experiences. Whether the stop was valid is not an issue. Based on the facts that you gave me the stop by the police was reasonable. Not having your front lights on at night does create reasonable suspicion to make an investigatory stop. You have two issues, improper license on the automobile and possesion of marijuana. On both issues you will have...

Probation/Exrtadition in another state?

Asked by a user in Long Beach, CA - over 3 years ago.

The best and most ethical advice that I can give you is to keep all proof of your mother's health situatuion, mail copies to your PO, and if your PO decides to try to violate you, get in front of a judge in TN at your violation hearing and expalin your situation. The judge will most likely allow you to reschedule your time in jail. If you are violated , TN will report this to NCIS but will most likely put a notation on whether to extradite from certain distances or states. Most of the...

My personal injury lawyer died what action should I take...

Asked by a user in New York - about 3 years ago.

Contact your state bar association or state board of professional responsibility. Those offices should be able to guide you under the rules of your state. Generally, under the rules of ethics an attorney is shall have an attorney designated to take over the case in the event that he or she becomes incapicitated. The rule usually applies to solo practitioners. If your attorney had a partner then you should contact the office in order to inquire about whether he will be taking over as the...

Two DUIs. First violation. 0.013% BAC Will this be a third DUI?

Asked by a user in Los Angeles, CA - about 3 years ago.

No. Not at .013 BAC. My Disclaimer: I am not your attorney and I am basing my answer mostly on TN law, general DUI laws in most of the states in the U.S. and my limited knowledge of CA law. Based on my research of Southern CA police practices and the facts that you have given, it appears that the police take properly licensed/tagged automobiles very seriously and highly scrutinize any possible violation. From the facts given by you, I am thinking that you were given a citation for your...

I was recently in a wreck that was not my fault, and I think I did not get what I think I deserve. Can I do anything about it?

Asked by a user in Seymour, IN - over 3 years ago.

In TN, if the other driver is found to be at least 51% at fault for the accident, you can be compensated for your injuries, any treatment you have to undergo, missed work, pain and suffering. An insurance company will try to pay as little as possible for your injuries. You are better off hiring a lawyer to guide you through the process. Statistics show that the usual settlement, when dealing with insurance company attorenys, is 1.8 to 2.4 times your medical bills. A good settlement would be 3...
