Can two incidents of unreported domestic violence be used as leverage in a divorce case?

Asked by a user in Tampa, FL - over 2 years ago.

Yes, you can use the incidents as evidence. I would have been easier to prove if you reported the events as they happened. But that does not mean you cannot present the information to the court. Asked by a user in Naples, FL - over 2 years ago.

As long as the other party did not file a counterpetition, you can dismiss your petition with no problem. You are free to refile it at a later time. I have custody but he keeps harassing me about her medical treatment (4 years after the divorce). Do I have to comply?

Asked by a user in Hudson, FL - about 2 years ago.

Technically you should communicate with him. A lot depends on the wording of the final judgment. If you are willing to "roll the dice", you can refuse to cooperate with him. This will force him to seek rights through the court. My friend is filing for divorce, her and her husband have 4 children. he is not working and still took away 2 of the children.

Asked by a user in Miami, FL - over 2 years ago.

Unfortunately many times there is a tug of war over the children. Both parents have EQUAL rights. Only a judge can define what those rights are. That will happen at some point in the divorce. My husband and I have signed the legal separation papers and are waiting in a court date. it was agreed I keep the home,

Asked by a user in Pensacola, FL - over 2 years ago.

There is not much you can do at the moment - without a court hearing. I assume he gave you the house and that is detailed in the agreement? The final hearing should fix the problem - so see what you can do to get a prompt hearing. Wife filled out "answer and waiver" form wrong. Court rejected it. She won't sign another one? What do I do? M for dflt? Help

Asked by a user in Astor, FL - over 2 years ago.

Because you have a signed Agreement, you should be able to proceed to a final hearing. You will need to call the Judge's assistant to schedule a final hearing. After that you must file and send to your spouse a "Notice of Hearing".
