I asked a question a few weeks back regarding a scheme to defraud case. Now they came back and served a search warrant.

Asked by a user in Bradenton, FL - about 1 year ago.

You need to hire an attorney immediately to investigate if the affidavit included any and all computers or just yours. Also the State Attorney should be contacted ASAP to try to arrange the release of the computer once the police have finished their investigation. If they discover new evidence of other crimes they can come back and arrest you on new charges.

HOW DO I GET A WORK PERMIT

Asked by a user in New Port Richey, FL - 6 days ago.

We would need more information as to the nature of the suspension, for instance is it related to a child support issue or perhaps an accident that you had with out having sufficient insurance or a prior criminal conviction that carried a suspension of your license. Please call my office @ 727-843-0097 so we can further discuss this matter.

I was charged with aiding arrest without violence, a crime i turly didn't commit.

Asked by a user in Miami, FL - 3 months ago.

I would agree that you would probably not have success at trying to open the case after 10 years. However, If you did receive a withhold of adjudication you may be able to pursue a sealing of the record of the crime. You can visit the FDLE web site and print out the application to apply for the certificate of eligibility. Once submitted with the appropriate documentation and you do receive the certificate you should contact an attorney to help you with the Motion in Court

Just a question about lawyer career! please

Asked by a user in Pompano Beach, FL - 4 months ago.

In a number of Circuits in Florida there are Juvenile Justice Teen Court diversion programs that introduce the justice system to high school students. The active members actually act as Judge and Jury on cases in so far as they listen to the case and decide what punishment should be given to the youth before the Court. Reading and writing skills are imperative but be yourself and when you get to college take the courses and major in what you enjoy. You never know what path your life will take--...

Can you get in trouble for being with someone who shoplifts?

Asked by a user in Fort Myers, FL - 8 months ago.

Did you ride together to the store? Did you stay with your friend after he/she stole the items? Did you walk out of the store together? These are simple questions that the prosecutor may ask the police to see if they want to charge the second person. Most decent size stores have extensive video capability so that may also play a role in the ultimate decision.Best advice: Find a new friend.

3 dwai in new york state 30 years ago , and one now in florida, will dmv use the ones from ny against me?

Asked by a user in Saint Petersburg, FL - about 1 year ago.

One further note. 30 years ago the law in New York was that the offense of DUAI was simply an infraction and was not considered a "criminal" offense. Normally one rec'd. a fine and was instructed to get their d.l. back. Your attorney in Florida should be made aware of this as this may affect the position of the State Attorney in Florida.

At what stages of a criminal prosecution must an incompetent criminal defendant be represented by counsel?

Asked by a user in Dade City, FL - 9 months ago.

With the issue of competency the Court will normally appoint Counsel once the issue has been properly raised. There is no "requirement per se'' as in the cases where an individual is represnting him / her self. The Court will order an examination and, based on the results, may be forced to appoint counsel if it appears the defendant is incompetent to proceed. An attorney normally remains the counsel of record unless he/she makes a motion to withdraw and said motion is granted by the Court. You...

Is this correct? can I do anything for relief of my sentencing order from an old D.U.I.?

Asked by a user in Jacksonville, FL - 12 months ago.

You should ask the DMV why they requested an ignition interlock device. Did you have a high intoxilizer result? I foyu did there is very little you can do. If the DMV cannot explain their actions your only recourse is to set a hearing in the Circuit Court askink for relief from this imposition.

Question

Asked by a user in Port Richey, FL - 4 months ago.

Be very careful as each jurisdiction handles DWLSR cases diferently. A first time in Pasco will normally be, at worst, a fine. A first time in a County north of Pasco can carry a jail sentence. It would be advisable to contact a Lake County attorney for your best advice. You can always do community service in your home County.

I am on probation in the state of florida and gained permission for a 10 day leave to colorado. What if I miss my flight?

Asked by a user in Orlando, FL - 4 months ago.

Your probation officer would certainly violate you. Work out a compromise before you go. Remember to document all your efforts in looking for a job or your probation officer may violate you for "taking a vacation" as opposed to a legitimate trip to look for work.
