On March 12, 2009, at approximately 1:30 p.m., an eleven member jury rendered their verdict in a trial which began on March 2, 2009 in the United States District Court, Middle District of Florida.
The jury heard eight days of testimony regarding the Wrongful Death lawsuit, filed on behalf of the Estate of Michael K. Bandsuch, by local attorney Scot D. Goldberg, of Goldberg, Racila, Dâ€™Alessandro & Noone, LLC.
The tragic crash occurred in the darkness of the early morning hours of December 22, 2004, when Michael K. Bandsuch was driving his GMC pick-up truck, southbound, along Metro Parkway in Fort Myers, Lee County, Florida. His pick-up truck collided with a Werner Enterprises truck and trailer, operated by Percy Johnson, of Alabama, which was perpendicular to Mr. Bandsuchâ€™s lane of travel and totally blocking both southbound lanes and a major portion of the center turn lane on Metro Parkway. The collision between the Werner Enterprises trailer and Mr. Bandsuchâ€™s pick-up truck resulted in fatal injuries to Michael K. Bandsuch.
Subsequent to the traffic crash and the investigation conducted by Cpl. Cribbs, of the Florida Highway Patrol, Percy Johnson was issued a citation for improper left turn.
At the civil trial, attorneys for Werner Enterprises and Percy Johnson denied any liability and defended the case alleging that their driver was engaged in a legal backing maneuver, and that the crash was solely the result of the negligence of Michael K. Bandsuch.

Attorneys Michael Noone and Scot Goldberg represented a young married couple in a case involving devastating injuries to one of the clients. The couple was involved in an automobile accident, which occurred when another driver ran a stop sign and crashed into their vehicle. As a result of the accident, the husband was rendered quadriplegic.
Prior to the trial in this case, the highest offer by the defense was $1 Million. At the end of the 3-day trial, the jury returned with a verdict of just under $28 Million.
The clients were quoted in the local media as saying, "I think I owe an enormous debt of gratitude to this team" and "I would say that justice has been done".
The verdict is believed to be the highest in Lee County history in a case in which a defense was presented on behalf of the at-fault party.
