While it is very possible to win a trafficking case at trial, we would need more details about your case. You should also know that there is no guarantee of winning at trial and there is a real possibility of receiving more then just the three years. These are VERY serious charges. A robbery with a weapon is a First degree felony, punishable by up to 30 years per count. Depending on when and what priors he has, he may be facing at a minimum years or decades in prison. You should speak with an attorney asap. It sounds like your father may be eligible for a departure based on mental illness. A good defense lawyer can investigate the facts of the case and may be able to resolve it favorably. A police report is not evidence and cannot be introduced as such. You may be able to impeach the officer's statements by using the police report to "refresh his recollection". Good luck, 727.286.6141

I agree with the other gentlemen. This is a felony and is punishable by up to five years in prison and a lifetime driving suspension. A good lawyer may be able to lessen the charges or at least minimize her son's punishment. Good luck, 727.286.6141

This sounds like you were charged with a trafficking and the state agreed to reduce it to a sale. That would be contingent on you accepting the state's offer. As the state was the one who reduced the charge, the judge will have no say in it. My only advice to you would be to check with the state and see if they would agree to postpone a sentence until you get better. The final choice on wheteher or not to postpone will be theirs...
