I found a full length press on nail, glue attached, in my drink, at a restaurant after i drank from it. Can I sue?

Asked by a user in Fort Lauderdale, FL - 5 months ago.

What are your damages? Without permanent harm/injury, it would be difficult to prevail in a lawsuit. Good luck, Nicholas Dorsten, Esq. 727.286.6141

What are the possibilities of going to trial on a marijuana trafficking case?

Asked by a user in Fort Lauderdale, FL - 10 days ago.

While it is very possible to win a trafficking case at trial, we would need more details about your case. You should also know that there is no guarantee of winning at trial and there is a real possibility of receiving more then just the three years. To answer your other questions, no your sentence would be a three year day-for-day sentence, no parole or suspended sentence and it would be served inside a prison. Finally, even if you show a jury you are not guilty of trafficking, you can...

My father just recently got arrested on 3 counts of robbery with a weapon he has bipolar and a drug addition how much time carry

Asked by a user in Tampa, FL - 4 months ago.

These are VERY serious charges. A robbery with a weapon is a First degree felony, punishable by up to 30 years per count. Depending on when and what priors he has, he may be facing at a minimum years or decades in prison. You should speak with an attorney asap. It sounds like your father may be eligible for a departure based on mental illness. A good defense lawyer can investigate the facts of the case and may be able to resolve it favorably. I practice often in the Tampa Bay area....

Statute of limitations on domestic violence in Florida?

Asked by a user in Orlando, FL - 4 months ago.

The statute of limitations would not have run out based on the timeline you gave. However, it is very unlikely that the state attorney would pick up the case now as your friend had previously refused to press charges. Good luck, Nicholas Dorsten, Esq.

How do you impeach with a police report?

Asked by a user in Tampa, FL - 3 months ago.

A police report is not evidence and cannot be introduced as such. You may be able to impeach the officer's statements by using the police report to "refresh his recollection". Good luck, 727.286.6141

I have a adjudication withheld on a animal cruelty charge. Would i be better off sealing it or expunging it?

Asked by a user in North Port, FL - about 1 month ago.

Because there was a plea in this case, you will need to seal it first. Once it is sealed, you will have the option of expunging the case at a later time. Good luck, 727.286.6141

Should my step grandmother pay money for an attorney for her son who was clearly guilty of his 4th dui in fl?

Asked by a user in Lakeland, FL - 3 months ago.

I agree with the other gentlemen. This is a felony and is punishable by up to five years in prison and a lifetime driving suspension. A good lawyer may be able to lessen the charges or at least minimize her son's punishment. Good luck, 727.286.6141

In pinellas county fl. does the judge or does the prosecution decied what a sentance will be for trafficing oxy codone....

Asked by a user in Largo, FL - 4 months ago.

This sounds like you were charged with a trafficking and the state agreed to reduce it to a sale. That would be contingent on you accepting the state's offer. As the state was the one who reduced the charge, the judge will have no say in it. My only advice to you would be to check with the state and see if they would agree to postpone a sentence until you get better. The final choice on wheteher or not to postpone will be theirs... What can I do about my dui convictions I just want a good job

Asked by a user in Fort Lauderdale, FL - 4 months ago.

I agree with Mr. Regan. In the state of Florida a DUI conviction can not be sealed or expunged. These charges will be on your record, probably forever. Good luck, Blake & Dorsten, P.A.
