How is it possible to be charged w/drug trafficking when actually the police approached the car for Sales & Delivery.

Asked by a user in Ormond Beach, FL - about 1 year ago.

The weight of the drugs determines whether or not it is drug trafficking. The State Attorney controls what type of charge is filed and prosecuted. Drug trafficking charges are very serious and require a mandatory prison sentence. There are exceptions and you can gather more information from my website. Go to the link below and educate yourself about this law.

What are the chances when charged with first degree grand theft, and the feds decide to take over the case.

Asked by a user in Miami, FL - almost 2 years ago.

Restitution is also a factor taken into consideration at sentencing. A good faith effort to make the victim whole and and to satisfy the restitution can be very beneficial when dealing with any theft charge. I do agree that an attorney in your situation will help navigate and make probation a possibility. For more information about the how the courts determine the amount of restitution visit our website at http://www.roothlawgroup.com/faqs/what-is-restitution.cfm

How does pretrial intervention show on background check?

Asked by a user in Tampa, FL - about 2 years ago.

Expungement after completing PTI is the start. If the employer runs a background check through a third party background check company the arrest will most likely still show. Most employers can't read background checks or understand them. Contacting the third party background check company to remove the arrest record is the final step.

Expunging a case in Florida

Asked by a user in Miami, FL - about 1 year ago.

Mr. Bowdish is correct and provided you with a great deal of information. To add to that, if you decide to expunge this case also consider taking it a step further and request the private background check companies remove the information as well. This is not an easy process and you will have to request the removal of your record from them directly.

I had two DWLS ans one unknowing DWLS and I received notice of becoming a Habitual traffic offender but one was dismissed what h

Asked by a user in Jacksonville, FL - about 1 year ago.

Habitual Traffic Offender has more to do with the type of charge than points. Points make no difference for this suspension. There are other suspensions resulting from points. Driving on a suspended license with or without knowledge is its own animal and a combination of 3 charges in 5 years results in the 5 year suspension. How you were sentenced and whether it was charged with or without knowledge is extremely important. Contact a Florida lawyer for help on this. The Clerk of...

Accidential shooting

Asked by a user in Tampa, FL - almost 2 years ago.

If you do end up facing charges the friend will play a key role as well in how this is resolved. They can advocate for you as the victim. If you are in this situation you should hire an attorney immediately to guide you through this.

DUI Arrest after wine tasting class

Asked by a user in Miami, FL - almost 2 years ago.

I do not see anything out of the ordinary regarding the DUI plea. Whether the school is liable for anything? Did they force you to drink? If yes then maybe you have something but I would be surprised if that was the case. Why they want you to notify HR is anyones guess but it probably has to due with the alcohol consumption on school grounds. You may want to consult an employment lawyer. Ryan

My mother was arrested for doctor shopping ,she is in her sixties and has no criminal record. She was let out of jail ror.

Asked by a user in Jacksonville, FL - almost 2 years ago.

There is a possibility but as a first time offender it is unlikely. But be careful and make sure you fully understand what is happening or the effects of any plea. Simple mistakes cause a lifetime of problems. Look into hiring an attorney to get the proper guidance through the system. Ryan
