Cannot Get A Response From My Personal Injury Attorney

Asked by a user in Tampa, FL - about 1 month ago.

You didnt say whether your lawyer was a small firm or a big firm that advertises on television. If your lawyer is a big firm advertising on television, it is no surprise that you are getting the run around, and your case has not settled. Often in big firms, the legal assistant handles the case from start to finish and very little effort is made unless it is a large dollar case. If you reached MMI and got a final from your doctor in December, it seems like three months is enough to have reached...

Hit in the back at a red light, other driver car total,I have head and neck pain my husb did not pay ins.premium what can I do?

Asked by a user in Tampa, FL - about 1 month ago.

You can still bring a claim against the at fault driver for the damage to your automobile, as well as a bodily injury claim for your personal injury. Since you dont have PIP the at fault driver is not obligated to pay the first $10,000 of your medical bills, as your PIP would have covered it and it appears that it is your husbands fault that the insurance lapsed. If you have health insurance you may be able to use your health insurance to cover your medical bills for this accident, but they...

Old divorce any way to override?

Asked by a user in Jacksonville, FL - almost 2 years ago.

In order to answer this question, you should meet with a family law lawyer and have him or her review the final judgement and marital settlement agreement. Based upon your question, is appears that he gets half "if she sells the house" but does not address what happens if she dies and never sold it. You may also need to consult with a real estate attorney and a probate attorney. There are way too many unanswered questions to be able to give you a short answer here.

Should I file a response to an appeal in a divorce Mater/

Asked by a user in Naples, FL - almost 2 years ago.

You should definitely file a response with the appellate court. Failure to respond will mean that the court will be considering only your former spouses brief. Further it may appear that you do not oppose your former spouses position. I suggest you contact your local bar association and find out if they have any legal assistance for you. Some courts have a prose legal help division where you can meet with a lawyer for a small fee and receive guideance on your legal matter. Appeals are...

Drunk driver hit me, do I need a lawyer?

Asked by a user in Missoula, MT - about 1 month ago.

If the at fault driver that hit you was DUI you can seek restitution through the state attorney as a condition of any sentence that the court imposes on that indvidual in the criminal case. In addition if you have insurance you can proceed through your own insurance for the repairs to your vehicle and they will seek subrogation (reimbursement) from the at fault driver. If you are in Florida your own PIP insurance covers your medical bills up to $10,000 and after that if you have health...

If my son has made arrangement to pay what is owed how are they able to come after me for the monies?

Asked by a user in Jacksonville, FL - about 1 month ago.

Until the title is changed you are still the "owner" and as such that is whey they have come after you. You didnt say whether your son still lives in your house hold, but that could futher complicate things. Lawyers normally "follow the money" and as such go after any potential source of compensation for their client. You may end up in court at some point letting a court decide the extent of your liability for your sons actions.

Was in an auto accident about 2 months ago, the lady was at fault, she ran a red light. she had no insurance.

Asked by a user in Deltona, FL - 2 months ago.

First do not sign the release. Second hire a personal injury lawyer that can contact the at fault drivers insurance company and find out if they have liability coverage. Proceed with medical care for your injury through your PIP insurance.

Somebody hit my car and run, the police found the person but she gave the officer a cancelled insurance policy.

Asked by a user in Tampa, FL - 2 months ago.

If you have automobile insurance you can proceed through your own collision comprehensive coverage, and your insurance company will then attempt to subrogate (get reimbursed) from the at fault driver. You did not mention if you were injured or not, but if you were injured, your own PIP auto insurance will cover your medical bills up to $10,000. If you have uninsured motorist coverage (UM) you can proceed with a claim for your injury (if you are injured) under your own UM coverage, in place of...

Can a Marital Settlement Agreement be changed or canceled?

Asked by a user in Ocala, FL - almost 2 years ago.

It is going to depend on whether the court has issued a final judgment incorporating the MSA or not. If a final judgment has been issued, you have 30 days from the date the court signs the final judgment to file a motion for rehearing or notice of appeal. If the case has not gone to final hearing, you can file a motion with the court alleging that she was pressured or rushed in to signing and the MSA should be thrown out. You did not mention whether she had a lawyer representing her. If...

Is the website florida2hourdivorce.com company legit? I am thinking of using them to fill out my divorce papers.

Asked by a user in Orlando, FL - almost 2 years ago.

I am not familiar with the service you have referenced. You did not indicate where you lived or how long. If you want to file for divorce in Florida you must have been a legal resident of Florida for six months. I suggest you consult with a family law lawyer, however if you cannot afford legal representation, you can pick up the forms to file it your self at any court house in Florida for about $25. You dont need to use a web site to fill out divorce papers, they are very simple and have...
