Is this a Civil Rights violation?

Asked by a user in Tampa, FL - over 2 years ago.

I would recommend that you contact the ACLU of Florida. They have a Tampa office but I would recommend contact the main headquarters first. I appreciate the fact that you are concerned about this issue.

Grounds To Fire A Public Defender

Asked by a user in Deltona, FL - about 2 years ago.

I might make one last suggestion in addition to Mr. Mosca and Mr. Heyman, whos opinion and comments I respect. You might ask the PD, a) why he or she believes that you are guilty of the offense charged and b) how that might influence how he or she handles the case; c) whether there are still any legal issues involved in defending the case and d) what the attorney's strategy might be. It could be that you had put the attorney in a tough position: you want the attorney to be truthful with...

What kind of schooling does it take to become an immigration lawyer

Asked by a user in Sarasota, FL - over 2 years ago.

There are also accredited representatives, who are not necessarily lawyers. Although you asked about an immigration lawyer's education, I am including a link to the Department of Justice webpage about accredited representatives if this might be your question. "Any such representatives must be designated by a qualified organization, as recognized by the Board. A recognized organization must apply to the Board for accreditation of such a representative or representatives."

Oregon Theft 2 Charge - How can I get a reduced or diversion sentence?

Asked by a user in Beaverton, OR - almost 3 years ago.

Hello. I see that you are going to graduate school. Your post does not say if this is an allegation of shoplifting or some other type of minor theft. I believe that you want to try and avoid the possibility of a conviction for Theft II. I cannot advise you regarding Oregon law, but it is likely that Theft II is still a misdemeanor and that there may be a possibility of later expunging from your record. A diversion with the possibility of dismissal is better, but do you know if a...

Officer lied on report they had to dismiss case. Was my civil rights violated?

Asked by a user in Terre Haute, IN - about 2 years ago.

In discussing with a lawyer experienced with police misconduct, 1983 cases, it appears that you will also be able to show the damages you have sufferend by virtue of the news article, etc. (Lawyers have to consider the extent of damages, because the time and expense in litigation can be considerable. Of course, you will want to know what if any are costs you would have to advance in any fee agreement.) You might contact the "Peoples Law Office" in Chicago, Illinois. Its a nationally known...

How do you fight poorly counciled 18 year old hispanic told to accept guilty plea to felony theft for puppies and has ICE detain

Asked by a user in Indianapolis, IN - over 2 years ago.

An Indiana attorney (or wherever the plea took place) may be able to try and have the plea set aside or vacated. You will want to consult with an attorney who is experienced with this issue. A national expert on post conviction relief (for example, for failing to advise or for misadvice) is Norton Tooby in California. I have included a link below. You could also contact the American Immigration Lawyers Association. (The US Supreme Court just heard oral argument in the case of a Vietnam vet...
