Most Florida lawyer's retainer agreements on personal injury cases are for 33 1/3% if the case settles in pre-suit litigation. If the case goes to litigation, most fee agreements generally go up to 40%. If you have not retained an attorney, you may discuss the fee with him/her. If you have already signed the contract and have a copy of it, you generally can cancel it within 3 days of signing it, and that may be stated in there as well.
