Driving without motorcycle endorsement

Asked by a user in Daytona Beach, FL - over 3 years ago.

Driving without a motorcycle endorsement is a second degree misdemeanor, which is punishable by a maximum of 60 days in jail and a $500.00 fine. I can tell you that as a former prosecutor in Broward County and current defense attorney, I have never seen anyone receive jail time for such an offense. Every county is different and each State Attorney's Office has their own policies but I can tell you that in Palm Beach, Broward or dade County the typical sentence would be a minimal fine and...

My daughter was hit by a car while the care was making a left turn, while she was on her motorcycle in Florida. They were going

Asked by a user in Saint Cloud, FL - over 3 years ago.

Any statements by independent witnesses would be a huge help with supporting your daughter's version of how the accident happened. Many times adjustors show a lack of respect to someone who has not yer retained an attorney. They deny many claims with the hope that people will be discouraged and go away. I'm not suggesting that a lawyer could definitely change the outcome but in a situation like this, you rbest chance is to have an advocate on your side who has experience with such matters....

Motorcycle car accident, FL personal injury laws

Asked by a user in Orlando, FL - over 3 years ago.

The first thing you should do is contact an experienced criminal defense attorney. You have been charged with a serious felony that carries a potential lengthy prison sentence and a potential multi-year suspension of your driviers license. Before hiring an attorney, be sure to ask if the attorney if he or she has handled similar cases in the past. There are various defenses to the charge of Leaving the Scene of an Accident that may or may not apply to your case. Your attorney would need to...

WHAT CAN I DO LEGALLY IF A PHARMACY GIVES ME THE WRONG PRESCRIPTION?

Asked by a user in Silver Springs, FL - over 3 years ago.

You can consider yourself very lucky that you caught the mistake before your son took the wrong medication. Since there are no damages to your son, there really isn't much of a claim to pursue against Walgreens unless you could prove that the mistake was done deliberately.

Medical malpractice

Asked by a user in Fort Myers, FL - over 3 years ago.

Medical malpractice cases tend to be very complex and I would need a lot more information about your c-section, your current condition and any all available insurance policies before I could make a determination as to whether or not you have a case. If you would like to discuss this matter further, you can call my office for a free consultation.

What is the punishment for violating criminal citation code 316.1925 in FL state

Asked by a user in Melbourne, FL - over 3 years ago.

The officer cited you for Careless Driving, which is only a traffic infraction as opposed to a criminal violation such as DUI, Reckless Driving or Leaving the Scene of an Accident. The worst that can happen is you could potentially receive points on your license and you could also be ordered to attend a four or eight hour traffic school. If you do receive points, this could have an effect on your insurance premium. If you have not received a ticket since 2001, it is highly unlikely that you...

FL personal injury law, criminal liability for auto accident

Asked by a user in Clearwater, FL - over 3 years ago.

The good news is that you will definitely not go to prison or face any criminal charges for failure to pay any potential civil judgment relating to your car accident. The bad news is that if you were at fault for the accident, your auto insurance premium may go up, especially if you have had other accidents in the past few years. If there is a $50,000 limit on your policy and numerous legitimate claims outstanding, your insurance company will likely tender the entire policy limit and and...

Iwas in bad crash with 18wheeler(at fault),had multiple surgeries

Asked by a user in Jacksonville, FL - about 3 years ago.

The good news is that commercial trucks usually have excellent insurance coverage. If the truck driver was at fault for the accident, there are several ways we can go about protecting your rights and taking all steps necessary to fully compensate you for your injuries. I would need a lot more information about the case before I can provide a specific plan of attack but I would be happy to give you a free consultation. I got rear-ended by a school bus, I need legal help.

Asked by a user in Lutz, FL - over 3 years ago.

If you need to get your car repaired right away, you can go through your own insurance if you have collision and you will have to pay a deductable (usually $500.00) if you have one on your policy. Your insurance company can then pursue a claim with the bus insurance and you may get reimbursed your deductable. You may be required to give a statement over the phone, which will be helpful and any independent witness affadavits would go a long way backing up your version of what happened. If...

Your english is just fine and I can definitely help you and your friend through this difficult situation. I would need to get some more information before I can give you a more specific answer. I can tell you that if your friend was driving your car with your permission and the accident was not her fault, your...
