  • My 17 year old son was struck in the face and had his jaw broke in 3 places that now reqiurs surgry

the other youth was charged with 3rd degree felony battery .what dose that mean for us? and what do we do now ?

    Seth’s Answer

You should consult a Florida personal injury attorney to assess your son's potential claims against the assailant. In some instances, there are negligent security claims that can be pursued where the owner or manager of the property failed to do something they should have done and as a result the criminal attack occurred. In addition, the Florida Attorney General's Office administers a Crime Victim Compensation Program that could provide money for medical expenses and other purposes.

You should consult a Florida attorney who helps people with injury claims. Provide your the attorney with a copy of whatever papers or release that you signed in connection with your property damage claim. Florida is a no-fault state. This means that benefits under your personal auto policy will cover a portion of your medical expenses and part of your lost wages. You may have other coverages available, such as medical payments coverage which may supplement your no-fault benefits. Your Florida attorney will make sure that insurance benefits are fully and timely provided to you.

I agree that sending out press releases and contacting reporters can be effective. I would also suggest that you give thought to what you believe makes your case newsworthy? Why would the Wall Street Journal or anyother newspaper be interested in publishing a story about this case? If you are a class representative or a member of the class, then I suggest that you speak with Plaintiffs' counsel before you contact the media.

What paperwork did you receive about the class action? If you received a notice of settlement, this notice may provide important information concerning the deadline to opt out of the class action and the procedure for doing so. If you do not timely and properly opt out, then you may be bound by the terms of a court-approved settlement of the class action.

Your insurance company has a duty to defend you if you have bodily injury liability coverage. If so, speak with the attorney representing you in this lawsuit. Find out what the status of the case is. Ask the attorney to advise you whether he/she evaluates the plaintiff's claims as potentially exceeding the limits of bodily injury insurance on your policy.

    Seth’s Answer

I suggest that you consult with a Florida personal injury attorney to discuss what your rights are under Florida law and to assess what claims, if any, may be available to you. Then you would be in a position to decide what claims you'd like to pursue. If you had a Florida personal auto insurance policy on your vehicle, then this policy should provide no-fault or PIP benefits. These PIP benefits cover some of your medical expenses and some of your lost wages.
