We sold our business in Oct.2008. The buyer signed a promissory note and has made no payments as of today.

Depending on the language of your agreements, specifically the note, you may likely be able to sue for monies due now. Of course, the buyer may counterclaim against you despite his due diligence. You also need to consider collectibility of anyone you sue so you avoid spending good money in the form of legal fees going after an uncollectible debtor.
