If a neighbor batters me on my property can i sue their ins. carrier?

Your lawsuit would be against the neighbor. A suit directly against his insurance company isn't allowed in Florida. Ordinarily, the insurance company would defend the lawsuit and pay damages up to the limits of coverage. However, insurance usually covers negligent acts only and intentional acts are generally not covered. This means that your ability to recover money from the insurance company may depend on whether your neighbor meant to hurt you.

My estranged wife has received an accident settlement that happened when we were still living together.

I agree with Mr. Lundeen and just want to suggest you consider what you actually spent becasue of the accident. This would include what you spent for your wife's medical and living expenses as well as any household income your family was deprived of because of your wife's disability.
