Description: Defendant was charged with a Life Felony "Car Jacking with a Firearm." There was one eye-witness who was absolutely positive that she could identify the defendant. The attorney used his lengthy studies on eye-witness testimony and blew the witness out of the water culminating with a not guilty verdict. He integrated psychological material, what an expert would opine if one was available for trial, and education of the jurors as to what they would need to examine in order to analyze the ultimate question: was this identification "accurate" or was it "inaccurate?" Counsel educated the jurors during Voir Dire under their role of determining credibility of witnesses. Then he used the teaching material during openning statrements and closing arguments. He continued with the testimony of the police as to the witnesses initial description of the perpetrator and how the victim's identification grew as the case progressed through depositions, witness preparation at the State Attorney's Office and pre-trail conversations with police.
