Without more information, it would be difficult to call this "misconduct". I would suggest you schedule an appointment to meet with your lawyer to discuss your case. You can also send a detailed letter expressing your concerns. Hopefully that will resolve the issue.

I think the answer is that it depends on the specific facts and circumstances of your case and the language in the non-refundable retainer. Did the lawyer have to do any work at all? If so, given the amount of time that has passed, it seems unlikely that you will be able to receive a refund. Your concern is a legitmate one. As a plaintiff's lawyer, I have seen attorney's who are more interested in protecting the carrier than they are in representing the Defendant. While this is understandable as the insurance carrier pays their fee, in most cases it is not proper. I would suggest that you search for a lawyer who handles personal injury claims in the Atlanta area. The lawyer you retain must be licensed to practice in Georgia. I find it difficult to believe that if all of the facts are as you say, that you would not be able to find someone who will take the case.
