Description: At trial in a partition action between brother and sister, the judge awarded the plaintiff credit for improvements to the house made before he became a part owner of the house. He was a tenant at the time of the improvements totaling over $18,000.00. I appealed the trial court's decision and the appellate court agreed with my position. The resulting decision instructed the trial court to remove the $18,000 credit in the calculation of amounts payable to each party.
