    Description:
    At trial in a partition action between brother and sister, the judge awarded the plaintiff credit for improvements to the house made before he became a part owner of the house. He was a tenant at the time of the improvements totaling over $18,000.00. I appealed the trial court's decision and the appellate court agreed with my position. The resulting decision instructed the trial court to remove the $18,000 credit in the calculation of amounts payable to each party.

    Unifund CCR Partners sued my client on two credit card accounts totaling approximately $18,000. After some litigation they amended their complaint to a claim on just one credit card account for approximately $8,000. went to trial and the judge ruled that my client owed nothing. Plaintiff was not able to prove that they owned the debts being sued upon. My client won at trial.

    Description:
    My client sustained a severe shoulder injury which prevented him from returning to work. We attempted to negotiate settlement with the employer but they offered a ridiculously low amount to settle. We went to trial and the Judge ruled in my client's favor. My client was awarded Permanent Total Disability benefits for life.

    Description:
    My client, Gammage, was employed by MBM Corporation as a truck driver. He was injured while making a delivery in the course and scope of his employment. The employer denied that he was hurt on the job and refused to pay any benefits. My client was unable to return to full duty for close to one year. We went to trial and the Judge found that my client was injured on the job and awarded disability benefits for his time off work and required medical care to be paid by the employer.

    Description:
    Charles Thompson and Carol Conway entered into a written agreement before purchasing a house in 1982. In 2008 Thompson died and his personal representative in the probate case filed an action to Partition the property. The basic idea is to force the sale of the property so that the estate can take their share of the property and distribute it to the heirs. The written agreement between Thompson and Conway provided that if one party dies, the other gets to live in the home for the rest of their life. Judge found that the written agreement controlled the case and the personal representative cannot partition the property while Conway is alive.

    Description:
    My client was served with an eviction summons. I successfully had the eviction action dismissed then applied for attorneys fees. The trial judge felt that I was not entitled to fees and denied my claim. I filed an appeal and the appellate court agreed with my position. Result: trial judge reversed and attorney's fees awarded.
