If you completed a diversion program and the charge was dropped, you did not get a withhold of adj. and you can answer no. You should also consider expunging your records. You can do it by yourself. Process takes 4 -6 months and sometimes longer. However a lawyer can get you through process quicker and there are some legal issues that sometimes come up that are not obvious to a non-lawyer. the good news is that you can probably put this behind you. everyone deserves a second chance and if the state attorney in your area has a diversion program, you may be able to get this charge dropped and then later expunge it off your record. You can do it yourself but there is little technicalities that make it difficult to explain here. You want to hire a lawyer who is going to follow through with the expungement, copy you on all correspondence so you can create your own file to show in case you need to, and someone who has a process of getting this done as opposed to working strictly on litigated court cases. More thank likely it will not change your deal. However you must speak to you lawyer as soon as possible so he or she can advise you.

You need to check the clerk. If the charge in that case is Nolle Prossed, then you should be ok. However, if the clerk's office says you have a court date, I would call the PD, call the clerk because you do not want to miss a court date and have a warrant even mistakenly go out for you. Call your PD and advise what you have told us immediately. Good luck. First of it is great that you are in the program. Congratulations. once you complete the program (if it is in orange county), the State will then proceed to Nolle Prosequi the charges which is a fancy word for "drop" the charges. You then can try to expunge the record. Unfortunately for you, Florida is at will state. This means that most private businesses can refuse to hire you based upon your criminal record even if you do not have a conviction. If you had these charges dropped you can try to expunge them.

Unfortunately yes. Even the temporary possession of someone's else's property can be grounds for theft charge. If police contact you do not answer any questions regarding the theft without an attorney.
