What happens if you are given a rejection in the pre-trial diversion program for a 1st time DUI in Orange County, Orlando, FL?

Can i go to jail for useing prepaid card in my name? my ex b/f got it for me when he got one for hims self its the same account

If your name is on it your are probably safe, unless he claims that you used his information to obtain the card and put your name on it. Be careful before you use it and make sure you know what he told the police, you could be arrested if he says you obtained the card without his permission and used his money to get it.

How many years between crimes does your prior points work against you?

Usually you have to go 10 years conviction free for your prior points not to count against you. That is 10 years of not being on probation, not being in jail or prison.

How long can you be held in jail without seeing a judge?

They will normally hold for the other state for a reasonable time. You need to contact an attorney in the county in which he is being held. They can file a motion to get in front of the judge and try to get him released once a reasonable time has elapsed.

If i someone hes a warrant can they still have a lawyer work on their cases until they decide to turn themselves in?

Ex in jail for aggravated stalking /death threats

It would depend on the evidence and how strong it is. It seems like they will probably get him on the violation of the no contact order by making phone calls if you can authentic his voice and show when the calls were made. I do not know the facts of the underlying case so I cannot comment on that.

Capias warrant for a failure to appear for a misdemeanor probation violation has expired and citation status closed.

Call my office at 407-246-0066. I need to find out more information, because there is no statute of limitations on a violation of probation and once a warrant is issued your probation time freezes. I have clients who were on probation 30 years ago and violated and the warrant is still out there.

If I have a bench warrant, can i fly to the state that issued the warrant without going to jail?

I would not. I would hire a lawyer to try and get the bench warrant removed before you travel to that state.

Richard nailed it on the head. If you have reason to believe that the victim will not show and without her/him there is not enough evidence to go forward then file your Motion for Speedy trial.
