I am male 55 years and I come to us Orlando florida as tourist. I am charged with 2 counts of battery 784.03-7 with 5 witnesses and both female victims want prosecution against me. what punishment will I get. regards saad

    Bryce’s Answer

Nothing is certain and you have to fight for a good result. This is like asking before a football game, "what will the final score be?" It depends on many factors including when and who you hire to help you defend these charges. Other important factors are the facts of the case, judge, prosecutor and prior record. Every case is different. Good luck.

  • My son was arrested in April 2015, all his documents say he has been ROR'ed but they won't release him.

My son violated his probation. The charges were dropped but it didn't matter because he was being held without bond. His VOP hearing was yesterday in which he was ROR'ed but come to find out he wasn't released because his PD forgot to schedule b...

    Bryce’s Answer

He won't violate his probation if he misses his probation meeting because he is in jail. Sounds like the new charge was dropped but his probation case is still pending. That's why he is still in jail. Getting the new charge dropped doesn't automatically mean the VOP will be dropped. The State has the right to proceed on the VOP charge even if the new charge was dropped. It is a lesser burden and to the judges (not a jury) satisfaction on a VOP. The court sets the VOP arraignment and hearing dates, not the PD. You can hire a private attorney if you are not happy with the PD. Good luck.

To answer your question, yes, non-citizens can be detained at the border whether you are here legally or not. I've had this happen to clients that were lawfully here. You will eventually allowed re-entry but immigration may give you a new date/appointment with them so they can track your case. Good luck whatever you decide.

  • What an infomation means?

I was checking my case online and it says the charge and facing and then it says last action: Information. does it means that the prosecutors charged me already ?

    Bryce’s Answer

Yes, that's exactly what it means. By reading the top of the page for an Orange County case or the line above or below for a Seminole Counry case, you can see what charges were filed. Good luck.

  • Expunge

I'm currently in probation. The state charged me with 5 criminal cases but 4 of the case were Nolle Prosequi (NC) and 1 of the case is Adjudicated Guilty. I'm still in probation with this 1 case Adjudicated Guilty. My question is, I'm I allow...

    Bryce’s Answer

I am sorry to say that you are not eligible since you were adjudicated guilty of a criminal offense. That alone makes ineligible, even for other offenses that were dropped.

  • Will my car insurance company look at the court record or DMV driving record to determine my rates.

If I win the DMV BAR hearing and they reinstate my license, will this mean that the DUI will not show on my driving record, thus preventing my insurance rates from going up? Do insurance companies look at both the court and DMV outcome. What do th...

    Bryce’s Answer

In a word, yes. If you win DMV then nothing will be on your driving record. They base their decision on your driving record. If you win DMV nothing will show as of now. One down, one to go.

  • Do you have to be employed to participate in pretrial diversion?

If you are not a student and have been referred for less than 20 grams

    Bryce’s Answer

You have to either work, be looking for work, be a full-time student, a stay at home parent of a minor child or be declared disabled and unable to work. Misdemeanor diversion is much more flexible than felony diversion. Good luck.
