  • Can jail call your job?

Was arrested for driving without a license, coke, weed, paraphernalia and a gun. Before I left the jail someone there called my job and I was fired. Is the jail allowed to call your job to self report for you?

    Bryce’s Answer

I have no idea why the jail would call your job but it is not against the law. Felony probation will contact your employer, but I've not heard of this before. People at the jail have too much to do. Try to find out who at the jail called. This doesn't make sense. More likely someone that knew you found out about your arrest. Sorry about this. Bryce Fetter

    Bryce’s Answer

Not if they find out about your old PTD case. Orange County does not allow a prior PTD disposition. neither does Seminole. Good luck. Bryce Fetter

    Bryce’s Answer

Depends on what you violated for. I hope you get a bond. Make arrangements with an attorney and turn yourself in. That will help you out a bit and increase your chances of getting a bond if you are initially set on no-bond status. Good luck. Bryce Fetter

Yes, if you have no prior criminal history then you can seal your court file. Sealing and expungement are very similar. You would be eligible for a sealing. Good luck. Bryce Fetter.

  • I'd like to expunge or seal my single record in FL please

Almost 12 years ago I was booked on a misdemeanor (touch/strike) based on untrue testimony by my ex. It went to court and the verdict was ACTION-DROPPED/ABANDONED. I'd like to see what options I have to expunge or seal this record. No arrests etc....

    Bryce’s Answer

You can expunge this incident from your record if you have never been convicted of a crime. That would include before this incident as you posted no arrests since. Good luck! Bryce Fetter

  • Do I still need an fr44?

I got a dui in September 2011, haven't been driving since. Would like to get my license again.

    Bryce’s Answer

You will need an FR-44 for 36 consecutive months. Not driving does not get you out of it. Call around as insurance rates vary widely. Good luck.

  • I was arrested for dui a few weeks ago and have "araignnet" in a few weeks? I research diversion, is that available forme?

my situation is that i just had a death in a family and was drinking and was pulled over by my house. I heard that diversion isnt automatic and there are different rules. I didnt blow and I didnt do FSE's, once he said i had red eyes and reeked ...

    Bryce’s Answer

There is not a form. DUI ptd approval is a process and there are many case specific factors that will affect your eligibility. Dui ptd can be an option in Orange County. If you wee arrested a couple of weeks ago then double your court date because there is a quick turnaround in Orange County for a DUI court date--about 3 weeks. Good luck.

  • Just won my DV restraining order case, any chance the judge will drop the criminal battery charges?

'Victim' claims I beat her up, DV judge said the evidence didn't point to that. I have a plea day in 2 weeks with a different judge, and am more than willing to go to trial. Is it possible/likely that the prosecutor will drop charges? Can the judg...

    Bryce’s Answer

You can win one and lose the other or vice versa. Winning the injunction doesn't guaranteed a 'no file' if there is a willing victim. You had a judge today. In criminal court there is a jury. Winning today was a good thing though. The judge can't dismiss it now but the State can not file it. See what happens. Good luck. Bryce Fetter

    Bryce’s Answer

If you have a private attorney, he or she can file a motion with the court to allow international travel if you provide your itinerary....this may or may not cause you to start the program over...don't travel without an order/permit. Good luck.

  • I go to court 03/11, to avoid HOT, do I plead not guilty or nolo?

I have 2 dwls in 2014 one was without knowledge I just paid the ticket and another in 2015 with knowledge, which I have to go to court 03/11/2015, paid all my tickets and got my license back

    Bryce’s Answer

You mean HTO (habitual traffic offender). If you plea 'guilty' or 'no lo' to this DWLS charge you will be classified as a habitual traffic offender and you will lose your license for 5 years. You need to have your lawyer get the charge changed to a non-HTO offense so this wont be your third strike. Good luck. Bryce Fetter
