My insurance is covering their car damages but not their medical bills and now I have a settlement being filed against me and don't have the money to pay it

    Fadi’s Answer

Your question is not clear. What do you mean by a “settlement filed against” you? Is the injured party after you in person? Did he/she not release you when he settled with the insurance company? I need more info to answer your question.

    Fadi’s Answer

When a physician reaches the conclusion that his patient is, or could be, suffering from a disorder that is outside his area of expertise, he/she should refer this patient to another specialist. However, sometimes the referring physician needs to conduct several tests in order to reach that conclusion or ascertain what type of specialist is needed.

  • If a doctor misdiagnosis a patient but patient contacted Dr out-of-hours with info that pointed to new d(x), is this negligence?

Because a lot of appointments are rushed, and doctors only record patient symptoms that accord with their diagnoses- if a patient say contacts the doctor via email with a symptom that they forgot to mention in the appt, but the doctor ignores it o...

    Fadi’s Answer

When I practiced medicine, I’ve seen patient who forgot to mention a symptom during their first visit but remembered and reported it later; this happens sometimes. What should not happen is for the treating physician to ignore a later reported symptom. It is hard to decide whether your physician was negligent or not based on the limited amount of information in your question. The key question here is whether this physician’s alleged negligence lead to any harm to the patient. If there is no harm, usually there will be no action. Consult a local attorney and provide more details.

    Fadi’s Answer

The first step is to check for insurance coverage, BI, UM or UIM. If none, then the second step is to check and see if the responsible parties have any assets that you can go after. If none, then it will be very hard for an attorney to recover anything. Good luck
