At arraigment you plead guilty, not guilty or no contest. The judge will ask you if you need a public defender or do you intend to hire one.If you need a PD then you will be asked to fill out a financial affidavit attesting to your income and assets and debts etc.Your case will next be recheduled for a pre-trial where your atty and the state's atty will discuss the staus of your case and a possible resolution. When and if a hearing is scheduled at that time move to dismiss in that the time for speedy trial has run out.If this is causing you anxiety contact the officer who issued you the ticket and find out his intentions.Again once it gets set the judge should dismiss as being untimely.

Unfortunately you are at the mercy of DHSMV and the Sunshine counsel.You have to recieve the necessary conseling to satisfy the DUI course requirement. A DL is a privilage given by the DHSMV and until you satisfy all their requirements they will not issue you a DL The fact that you are broke does not matter ! I tell you this because the more yoe resist in satisfying their requirements the longer it will take to get reinstated.Also be prepared for reinstatement fees! Good luck!!

If you were not adjudicated guilty of the offense and you have no prior or subsequent arrest you would be eligible for record seal/expunction.The package to seal and expunge can be obtained online on the FDLE website or from the clerks office in your local. I would call his Judge's Judicial Assistant and ask her to do a transport order and send to sherrif in county where defendant is being held and the sherriff in county of the court in which the cherge is pending. The county in which he is being charged is obligated to go get him from the county in which he is being held. The sooner he gets to court the sooner he will get out. He gets credit for the time spent in another county.
I had a client with mental issues and no priors get a 10 year probationary sentence.Look for mitigating factors for downward departure from sentenceing guidelines.A good lawyer should know what mitigating factors the court should take into consideration.If restitution is an issue make the victims need for restitution a priority over incaceration as punishment.This will placate the victim and justify the court mking a downward departure.
