    Lots of concerns here...your narrative indicates nothing of the officer reading you an implied consent warning, so possible to have refusal evidence thrown out. If no implied consent, then no refusal and no administrative suspension. If implied consent was read and you refused, then you have to look at the 4th Amendment issue of probable cause to arrest. I assume the officer gave you a DDS 1205 temporary license, which requires you to request a hearing within 10 business days or your license...

    I agree with Mr. Marsh. What you have going for you is time. By the time you graduate form nursing school and begin to apply for your license, you will have built a record of "rule following." The First Offender conviction will certainly be available to the licensing board, but if you are forthright about it, I believe they will grant you a license, even if there are some conditions on it for a while. I represented a UGA DVM applicant with the same charge history and she is now a practicing...

    Say anything, just ask for the hearing. Say implied consent was not properly read if you think you were tricked into giving the breath sample. If you are going to hire an attorney, he/she will handle it for you. Don't delay. Sounds like the officer was throwing you a bone.

    YES. It may not affect mandatory sentencing, but the judge IS GOING to talk to you about it. Be prepared.
