  • Can a person be forced to choose from a small list of Bondsmen? If I spend my money,I should have the right to choose my bond co

Corruption of Legal Rights! Had to choose a bond company from the list given, not allowed to use a reputable Comp. This is my second DUI, The first I plead guilty after spending5days in jail for Failure to appear, because the crt Appntd Att. did no...

    Douglas’s Answer

Typically when a sheriff is elected he will chose the bonds company and then post a list. The sheriff must approve each company based on a number of factors the least of which is their ability to pay if everyone skips town.

Does seem like a monopoly however more than three companies gives you a choice.

  • Applying for US Citizenship with DWI record (PBJ for 1 day unsupervised) in 2006.

I consulted with a Immigration attorney about applying for my Citizenship with DWI record in 2006. He advised that I will still need to tell the immigration that I was arrested for DWI. If I hire him, i will need to pay him. My question is, can...

    Douglas’s Answer

I do not do immigration law ,however, my opinion is that the dui will have little to no effect based on the case of

Supreme Court of the United States
    Josue LEOCAL, Petitioner,
    v.
John D. ASHCROFT, Attorney General, et al.
    No. 03-583.
    Argued Oct. 12, 2004.
    Decided Nov. 9, 2004.

  • If an officer does breath analyzing on more than one person at the scene, how can they prove which one belongs to which person?

more than one person in car, all had been drinking at the same time, same thing (college kids) some were "drunk" some were not.

    Douglas’s Answer

typically the officer will separate all persons in the car with the main focus on the driver. Once separated the officer may elect to give a pbt to screen for consumption. Obviously the result is a go no go scenario. To identify consumption of alcohol at a certain level more specific tests need to be given.

  • If i have a DUI in massachusettes, is it legal for me to drive in southern,, and what is the statute of limitations of DUI in ma

or what other states can i drive? untill the matter is cleared up?

    Douglas’s Answer

imho, the state of Massachusettes can only dictate that you can not drive within the border of it's state. Massachusettes is without power to tell other states what to do. the laws of the state only apply to that state, it is not a federal crime.

that being said you probably want to clear up the dui so that no warrant catches you while you are in another state.
general sol in many states is two years.
