    Court of Appeals clearly defined the differences between felony forgery, 2nd degree and misdemeanor possession of a ficticious identification document and vacated the conviction, leading many prosecutors across the state to abandon the formerly standard practice of charging all immigrants with the felony offense when merely found in possession of a false document without any reason to believe there was an intent to defraud others.

    Defendant was one of 5 people charged with two counts of Commercial Gambling in connection with a horse farm where racing was being conducted. Defendant owned the property and the horses. Four others pled guilty in a deal with the DA to testify against the property owner. Jury returned a Not Guilty verdict, believing the defense attorneys presentation of facts which showed that any side-betting going on was not organized by the Defendant.

    Description:
    Defendant was charged with two separate offenses of possession of illegal drugs. During the trial, the defense attorney proved that the Defendant's girlfriend's biological mother and adoptive mother conspired to plant drugs in the Defendant's house three different times. Each time they called the police with an annonymous tip. The police didn't know they were being tricked. The biological and adoptive mothers conspired to ruin the Defendant's life and get him incarcerated in an effort to destroy his relationship with their daughter because they disapproved of the relationship. During the defense attorneys presentation of evidence, he completely deconstructed the State's theory of guilt. Near the end of the trial, the DA -- to her credit -- stood up in front of the jury and told the judge, "We'd like to dismiss all charges."
