    To the extent that um is available & was not contractually waived and if a special kind of release called a "limited release" was executed, then most likely, yes.

    A monetary recovery received from a car accident settlement is not treated at income by the IRS and thus it is not taxable.

    The other attorneys who commented are exactly correct. Talk it out /w your attorney. If he/she is not willing and if you have lost confidence in him, you need to find another attorney. Myself & others on this forum are fully competent & capable to assist you, BUT, you need to be vulnerable, authentic & totally honest with your current attorney & tell him how you really feel.     So sorry about what happened. That's awful. No, personal injury, including related to car accidents, is not just physical. You can recover damages for emotional harm (pain & suffering) caused as well, but you'll need an attorney versed & experienced in seeking those specific type of damages. Best wishes.

    The short answer to your question my friend, is "maybe". There are a particular set of circumstances that if existed @ the time of the accident could very well lead to the parents being equally responsible. We just don't know yet. This must have been a very scary. I am happy to speak with you further about your accident as I have been in several, have had surgery, pt & know what it's like to live with chronic pain.
