    Hello, I am so sorry that this happened to you. Sounds scary. For every problem, there's a solution. This is no exception. You need to talk it out. I know you are upset, but you'll feel better when you talk it out with an attorney. I know you know this, but this type of thing happens all of the time. I know it's a pain. Most important thing is that everyone is ok, but pain from a car accident sometimes does not show up for days or weeks. Talk it out & everything will be ok.     it really depends. An argument could be made that you are partially responsible for the bicycle accident. On the flip side, one could argue that the negligence of the tax cab is the main or "proximate" cause of the accident. I would advise not speaking to the insurance company and consult with an attorney right away if you have not yet already done so.     Oh boy, this is not a good situation. One of the challenges of our current tort system is that often times an injury case is really only as strong as the insurance coverage that the parties have, which is why is so, so important to have very, very good 'Underinsured" Motorist Coverage. You see, you have to assume that an at fault party has minimal coverage as required by law in the event that you get into a car accident, whether it is in Savannah, Atlanta, Macon, whatever. Most people & I understand, don't realize that insurance coverage is pretty cheap. The problem is that at times, the insurance company's & their agents push the worst coverage. Sad. but true. Regarding your specific situation, hopefully you have good health insurance and/or medical payments coverage. Basically, it sounds like your attorney determined that the at fault party has minimal coverage and that's why he/she is pushing that you take the $25k from the at fault party (/w a limited release) along with another $25k from your own insurance company (unless you waived the stackable coverage provision) rather than litigate & try the case. Either way, this is a bad situation and I'd rely on both your lawyer & non-lawyers for help thru this financial, legal & emotional crisis.     Can I ask if you are currently represented by an attorney? Yes or no is fine. Please do not mention the name of the attorney. If you are represented by an attorney, you really need to be addressing these questions to him/her. Notwithstanding that, it depends on your insurance & a few other factors.     All of these kind, smart, talented & brilliant attorney's who previously answered this question are rock stars & I want backstage passes! They all contributed to what is collectively a very good answer to your question. You need to continue a dialogue about this issue. It's sort of like when you talk about a problem with a therapist, friend or family member -- it just makes you feel better. What I tell people is that if a sitting United States Senator (Trent Lott) can be denied his own insurance claim, what does that say for the rest of us? State Farm is in the business to collect premiums and they are at times very difficult to deal with when it comes to paying claims. You need to talk with several different attorney's licensed in Georgia who are experienced in this area. I am one of them, but like I said there are many fine & effective attorney's available to help. Also, State Farm does not have a monopoly in the insurance industry. You do have other options. Take care & know that this is just a blip on the radar.
