    Technically, if the car is capable of moving, she can be charged with a DUI. Even if the car never actually moved. I'm wondering why the officer even approached her in the first place, if he saw her holding the beer or what. The outcome will depend partly on her history--if she has no prior alcohol-related charges, she should be fine with a good DUI attorney, but the prosecutor may push back more if she has had any prior issues.

    You have some excellent issues here that should make this a strong case for a reduction. The acid reflux diagnosis can really cast doubt on the breath rest result, and it's great that the diagnosis was before the arrest. Also, the court might not even get to that issue if there was no probable cause for the arrest. Without any field sobriety evaluations, you have a strong argument that the officer didn't have enough reason to arrest you. There's nothing illegal about having a couple of drinks...

    There is a possibility of jail time here, but there may be alternatives to that if you can get the probation officer and judge on board. Having a lawyer to negotiate on your behalf and present you to the judge in the best life possible can certainly help.

    It definitely helps that the officer believed you. The problem is, with 2 prior convictions, the prosecutor may still be reluctant to reduce or dismiss your case. You need a good attorney to negotiate on your behalf and perhaps conduct a motions hearing to have the officer testify in front of the judge. There may also be an issue with probation if you were ordered not to drink while on probation. Make a couple of phone calls--many of us offer payment plans if you don't have a ton of cash up front.

    Jail time is always a possibility, but it may depend on your court and your record (if any). A good DUI lawyer can give you the best chance at avoiding jail time and possibly avoiding the DUI to keep it off your record. Your license must also be protected. Call around and find someone you're comfortable with who's within your budget.

    The report usually will say that you performed poorly on the field sobriety evaluations. Remember, that report is written from the perspective of the arresting officer. But there are ways to cast doubt on that, with or without an arrest video. As for your license, there are several things that could be going on. If you took the state-administered chemical test, then sometimes the officer will allow you to keep your ID and won't file the paperwork to suspend the license, at least initially....

    This is better than being violated for another related offense (such as another DUI arrest), but it's still a pretty serious situation. He could be revoked for the balance of his probation, meaning he could spend the rest of that time in custody.
