  • What will most likely happen to him?! Will he be given bail ? Will he be sentenced to serve time in jail?

    James’s Answer

I suspect he will be given bail, and with the order that he does not have any violent contact with you. I seriously doubt he will get any jail time since this is his first offense.

This is not necessarily odd. However, no news is good news.

    James’s Answer

A true inability to pay is not a ground to revoke your probation, or First Offender status. However, you need to do everything else, including community service, to avoid running into trouble.

  • I am looking to have this charge removed from my record. Is this even possible due to federal laws?

I was charged with domestic assault when I was 18, I'm now 34 (16 yrs ago). I have no other charges on my record, have been serving honorably in the Military for 13 yrs, and do not plan on returning to the state I was charged in.

    James’s Answer

State law controls expungements/restrictions, and not federal law. If your charge was a misdemeanor, you may be able to expunge/restrict it under GA's new restriction laws with the youthful offender exception. Again, this is assuming your case was in Georgia, and it was a misdemeanor.

  • Do I need to wait out NC's 1 year DWI suspension to get my license back? or do I only have to complete GA's 120 day suspension?

Georgia resident with a DWI conviction in NC. NC DWI conviction requires a mandatory 1 year suspension. However, I have a GA license and I think I would qualify for GA's 120 day reinstatement provided I complete the necessary requirements for rein...

    James’s Answer

Your GA license will be suspend, and so will your privilege to drive in North Carolina. You will eventually need to reinstate your license in both states. Georgia may issue you a full license after 120 days, but don't forget to reinstate in NC in 12 months. If you don't this will eventually catch up to you one day when you try to renew your license, and they won't let you.

    James’s Answer

If you were read your rights after interrogation any statements you made could be inadmissible. However, there are so many exceptions to your Miranda Rights the rights themselves are almost worthless. The fcat you signed a waiver is not going to help you any.
