    I would suggest you speak to a qualified personal injury attorney in your area. YOu give very little information about your injuries, but if you sustained a physical injury then you should be able to recover for your medical bills. As for the emotional distress, the law in Georgia is that you cannot normally recover for emotional distress unless their was a physical touching.     I'll begin with a caveat in that I am not licensed in IL and you will need to speak to a local attorney for a more definitive answer, but yes, generally a workers' comp carrier will have a lien for reimbursement of medical expenses from a personal injury case that arises out of the same accident. I would suggest you consult with a local attorney.

    Generally on a contingency case, the attorney will take the agreed upon percentage, in your case 1/3, plus costs.
