She committed a crime in leaving the scene. She should not assume that she got away with it. She should contact a criminal defense attorney, who may advise her to turn herself in and make a clean breast of it, or may not depending upon the circumstances.

That sounds rotten, but I assume there are more facts than stated here. You should consult an attorney in your area who is experienced in estate and probate litigation. The big question whether the amount of money is sufficient to justify the cost of the legal battle.

Theoretically, in many states one could sue for malpractice and for battery due to performing an unauthorized procedure. But if there is no substantial harm resulting, beyond a little short term discomfort, I cannot imagine a seasoned lawyer wanting to take the case.

Personal injury liability claims are not typically paid until there is a release. If you have health insurance or if you have medical payments coverage under your auto policy, turn in your bills to be paid by your insurer. If you have continuing symptoms, you should be evaluated by a specialist (probably orthopedic surgeon or neurosurgeon) and consult a lawyer in your area who is highly experienced in personal injury litigation . I generally tell clients to slow down, make sure you known the...

There are very limited circumstances for getting around the statute of limitation. None of those are revealed in your statement of facts. Medical malpractice cases are wickedly tough. Adverse incidents and bad outcomes do not equal malpractice. There must be a violation of a standard of care. The financial risk for a lawyer handling a difficult malpractice case is compounded by expiration of the statute of limitation. Try to consult with a medical malpractice specialist (that's a pretty short...

Maybe, maybe not. It sounds shocking that the doctor did not do any of those things. If there was more reason to be concerned about her or her child medically, and you had little or no injury, that would be racially neutral explanation. It is unclear whether you are damaged by inadequate or delayed treatment. If not, it may be no harm, no foul. Moreover, emergency department malpractice in Georgia is requires clear and convincing evidence of willful or wanton negligence. That is a very hard...

I have been involved in hundreds of mediations, both as an attorney and as a mediator. In all those, I could count on the fingers of one hand the cases, other than medical malpractice, in which an insured defendant personally attended. The insurance adjuster has the checkbook. Your attorney understands that. He also may understand the futility of a lot of court ordered mediations with insurance companies that have a corporate policy to stonewall cases as long as possible. When i was on a...

Taxi cabs in Georgia generally have only $25,000 minimum limits liability insurance and the drivers are designated as "independent contractors" in an evasion of company responsibility for anything they do. I am challenging that in a catastrophic brain injury case now. But the fact that you did not have effective lights or reflectors on your bike at night is a problem. For my bike which I occasionally ride to the gym before sunrise, I have bright flashing strobe head and tail lights that...

Under a tort reform law passed by the General Assembly of Georgia in 2005, an emergency department or emergency physician can be held liable for malpractice only if a jury finds clear and convincing evidence of gross negligence. It is virtually impossible to carry that burden, particularly when the defense wins in malpractice cases 80% of the time anyway. Add to that medical testimony that the medical malpractice defense can always produce to justify anything and cultural bias among many jurors...

There are plenty of lawyers who are willing to take on the very nasty and aggressive "Rambo litigation" tactics employed by Wal-Mart defense lawyers. We have been there and done that. Remember that it will be necessary to prove your case and endure hours of hostile questioning on deposition by Wal-Mart's lawyers. Your lawyers will be there to back you up and object to what is objectionable, but you will have to answer the questions that are allowed. I have seen Wal-Mart send two lawyers to...
