I strongly agree with the other attorneys who have responded to your question. You are facing further license suspension and other penalties and that is why the judge asked you to consult with an attorney. Listen to him/her. Feel free to call me if you need to discuss this matter further. I provide a free consultation.

  • I received a citation for indecency at the entrance of a city park, what are the possible consequences?

It was inside a vehicle a few feet away from the park. The officers did not arrest us just handed us our citations and left.

    Janice’s Answer

In addition to the misdemeanor penalties (up to 12 months in jail and up to $1000 fine) you may need to register as a sex offender being that this is a sex offense. You should definitely consider hiring an attorney. Feel free to contact me.

  • In Georgia, once a legitimation order is given, can it be appealed if a DNA test proves another male is the biological father?

A few months ago, the male who thought he was the father was given an order of legitimation of my son in GA and is in a custody battle with the mother of my son. I recently took a DNA test and discovered that I am the biological father and not the...

    Janice’s Answer

An appeal of the order is probably not the move you want to make, but you should certainly file your own legitimation petition with the same court, preferably prior to the court entering its decision in the custody matter. You might want to consult with a family law attorney to assist you with this matter.

  • Failure to Appear issues for unpaid speeding ticket(GHP)

pulled over on suspended liscense and arrested, bonded to state court

    Janice’s Answer

If the speeding ticket is in city of Atlanta municipal court, you should be able to just pay off the fine for the fta and the fine for the speeding...but essentially you will be pleading guilty to the speeding and will incur points on your license. If you hire an attorney, they might be able to negotiate a more favorable outcome. You will especially need an attorney for the driving on a suspended license in state court.

  • Probation on speeding ticket

I was put on 12 mos probation for a speeding tkt (19 miles over). Court ordered me to take a Defensive Driving course which I completed along with 15 hours of community service in lieu of the $293 fine, however, I was placed on 12 mos. probation a...

    Janice’s Answer

Those are steep penalties for a traffic violation! I would not have advised you to take that deal. You would have been better off paying the fine and putting this behind you. I never advise my clients to go on probation in lieu of paying a fine. Worst case scenario, I would ask for non-reporting probation and that the probation be suspended as soon as the fine is paid. Best case scenario, I ask for a continuance so that the client gets some time to come up with the funds. Being on probation means that you have to report when they say you do and have to pay a fee each time. You cannot get in any trouble and they may limit your ability to travel. Being on probation is a little dangerous because if you commit any other infraction you are immediately taken to jail and will not be able to get out until you can be placed on the judge's calender so the judge can decide whether your probation will be revoked and you have to serve the time. By you taking this deal, you had to have either plead guilty or nolo, so I do not believe you can undo it. I am sure you remember the judge asking you if you understand what you are doing and if you are voluntarily making the plea. What you might want to consider asking your probation officer is whether you can serve your probation in the state you plan to move and report to a probation office there.

  • I have to appear in court for a "driving with a suspended license" charge. The short version is

I got a traffic ticket for making a turn on a street in downtown atl that has no turns (did not know). Got back to off iand put ticket in my desk and forgot about it. Missed the court date for the tickect and the summons was sent to my old address...

    Janice’s Answer

I will need a little more information. Typically, the court makes you pay a fine to get in front of a judge, if it is necessary -- i.e., if it the type of charge where appearance in front of a judge is mandatory...e.g., driving with a suspended license, etc...Your case does not sound like one where an appearance is necessary. Based on experience, I believe by you paying the fee you have taken care of the charge; but I have no way of knowing for sure as most courts have their own procedures.
