    You might be able to get workers' compensation benefits. Failing a drug test means that there is a "rebuttable presumption" against you. That means that you have to prove that whatever caused you to fail the drug test did not have anything to do with why you were hurt. It is highly unlikely that a company will accept your claim under these conditions. You need to hire a lawyer to help you.

    Yes. You can get a second opinion from another doctor on the panel of physicians. Ask your adjuster.

    Why would they order a deposition.

    This is very standard practice. The deposition is taken for two purposes. One is to find out your side of the story. The second is to learn about your background and see what kind of witness you would be. You should definitely have an attorney at this point in the proceedings.

    I am a little confused. What happened to the restrictions from the first doctor? If that was your authorized treating physician, what he said would take priority. I would also consider going back to him to see about your restrictions. Please clarify what you wrote.

    Workers' compensation does not work like that. You could be eligible to receive money for a disability rating if you have one. I would suggest that you talk to a lawyer to evaluate the value of your case and the benefits for which you are eligible.

  • I am a over the road truck driver and was rear ended on the interstate in Indiana. My workers comp follows Arkansas law. But my

    You will need to talk with the lawyer representing you in the Indiana case as the law in each state is different. If you had a Georgia lawsuit you would not have to reimburse the Arkansas WC carrier but the law in Indiana could be different.
