It does not sound like you are at fault for the accident, but it depends on all the facts and what you can actually prove. If you are filing a claim against the other driver you should speak to an attorney as soon as possible. If you are not, but the other driver is filing a claim against you, cooperate with your insurance company in their investigation so they can make the proper decision regarding denying that claim. I recommend you call your attorney's office to set up an appointment to meet with him/her to discuss the issues you are facing. It may be that there is nothing he can do immediately to resolve your issues as there is often no monetary relief from the at-fault party until the matter is settled. However, I'm sure your this is something your attorney will be happy to discus with you. If you are unable to get your questions answered, you have a right under Georgia law to discharge your...

The failure of a police office to cite anyone in the collision is not the issue. The real question is which driver caused the collision. As you can understand, the answer is not always clear. Sometimes the negligence of both drivers may combine to cause the collision. The issue in these cases is what the percentage of fault is for each driver. If the other driver was more than fifty percent at fault, then Georgia law requires his insurance company to pay its pro-rata share of the damage....

You have learned 2 lessons the hard way. First, never admit fault at the scene. Leave that for experts who know the law. Second, it's always a good idea to call the police to document what actually happened. It also makes the insurance companies happy. That being said, RELAX! You were smart enough to purchase liability insurance. They will defend you at no cost and pay anything you owe (assuming it is within your insurance liability limits). All you need to do is cooperate fully with...

It is always possible to damage your personal injury case when you deal directly with the insurance company without first consulting with an attorney. Insurance companies take recorded statements in order to use them against you. It is never to your advantage to give one. Additionally, as Mr. Brinkmeier has stated, the property damage check or release could contain wording that may damage your case. You should consult with an attorney right away. Steven I. . The Defense Attorney can have the deposition transcribed at any time. However, most defense counsel ask that it be transcribed immediately since the insurance company pays for it. It may mean that they will attempt to settle with you before trial. If it does not settle, he'll have it transcribed prior to trial Steven I. Under Georgia law, you must prove the store either created the dangerous condition or had knowledge of it prior to your fall. If it was raining outside and the rug was at the entranceway, the Courts have not been very kind to injured parties and throw most of those cases out of Court. Of course Mr. Levy is correct that you must prove injuries resulting from the fall to be able to collect damages. Steven I. Mr. Forehand is correct. If you are in need of medical treatment, you should have your case reviewed by an attorney as soon as possible. Make sure you do not give any written or recorded statements to any insurance company before you have consulted with an attorney. Steven I.
