The past three weeks have been post holiday. Failure to return calls for status updates is not neglect of a matter - status updates are rarely productive, take 15-25 minutes to get the file and review it, then another 5-15 minutes discussing the current condition of the case with the client: Multiply that times 15-30 and you have a substantial amount of time during working hours being spent on absolutely nothing productive. When you hire a lawyer and want immediate and frequent "keep me...

I think your recourse is to make a motion in probate court to remove the administrator. Since you already have an attorney just make an appointment with him or her and talk about it and I am sure he or she will give you a reasonable estimate of the cost of the endeavor.

The situation you set forth is an arrest and reasonable bail for the arrest. Whether there is probable cause will be a question for the first hearing which is going to take place within 72 hours, most jurisdictions are holding them in less time. The lack of proof you set out is the defense to the charge if at the first hearing it is determined that there is enough to go forward. It is a dire situation and one for which I advise that you seek immediate legal counsel and representation. At a...

Adverse possession under the 7 year rule demands some sort of color of title - the variants of which comprise several law school lectures. The 21 year rule mandates adverse possession in defiance of any other's claim and 21 years basically without dispute. I don't think your sister has a chance but get an appointment with a lawyer to discuss the matter at length - a 30 minute consult.

A major qualification to any legal opinion is always, what's at stake, a million dollars or a hundred dollars. My advice to to immediately schedule an appointment and get a bona fide opinion. In general the language you quoted would omit the share going to the deceased beneficiary but without seeing the Will in person I will not state that as opinion. Phrases like "per stirpes" and "...share and share alike" will leave a beneficiary's share under a Will to the heirs of that beneficiary in...

Your question has a lot of missing information and instead your conclusions. The answer to the question is "Yes ... but ...". A more complete answer would concern knowing: (1) the child's age and gender; (2) your ability to financially support yourself and the child; (3) extended family that are willing to help you; (4) what was before the Court and the Court's ruling; (5) your medical history and diagnosis; (5-100 +/-) a lot of other factors ...

Yes, however, reinstatement may be an incorrect description of getting benefits. You need to retain an attorney immediately regarding the matter. I would recommend Randy Ebersbach down the road from me. He is with the firm Kam, Ebersbach & Lewis and please tell him I referred you to him.

With the Caveat that your question requires research and I don't know a lawyer that will research and answer a fact specific question like yours without being paid and I am providing my un-researched off the cuff opinion based solely on 22 years of practice in the area, I have never heard that a DUI conviction would have any effect on a Certified Public Accountant License. It is not a crime of moral turpitude. Apart from wrecking your insurance for several years to come, a DUI effects a...

It sounds like you have a claim for conversion, attorneys fees and possible punitive damages against the Shop and possibly against your insurance company. You should not settle with the insurance company before you consult with an attorney. I will not take your case as it is two counties away, however, there are probably two dozen outstanding attorneys in your area and II suggest you call one as soon as possible. I either know or have heard good things about the following: Robert Ingram,...

Your refusal of the field tests should not have any impact with the courts, at least none that I am aware of here in Coweta and the surrounding Counties. I will caveat that statement, however, with the stipulation that the video of your refusal will not show you being belligerent or a smart-alec with the investigating officer. At any rate the Courts work hard to be uniform in sentencing no matter the circumstances. However, it is my opinion that you need representation and you need it early...
