Your local city is considered special, so to say. Now, special is not a legal term, but rather to imply the law has been written to benefit them. In this case, I believe that it has. This is a great question about the difference between civil law and criminal law. Driving on a suspended license is going to be a criminal violation in your state, most likely. The question is did your cousin's not having a license contribute to the accident. It does not seem like it did. Those are different issues. It sounds like you have a claim.
